Terms & Conditions

1. Agreement to Terms

By accessing or using Apertist, you agree to be bound by these Terms & Conditions and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Description of Service

Apertist provides automated AI-based image analysis to photographers. Users can upload JPEG files and purchase customized photo editing guides and presets.

Each new user is eligible for one (1) free initial analysis (consisting of the step-by-step editing guide only, excluding presets), subject to verification and account history. Subsequent analyses are charged in accordance with our pricing schedule.

3. Account Registration & Security

To use the payment-based features, you must register for an account using email/password, Google, or Facebook login. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Payments, Balances, & Refunds

Our service utilizes a prepaid account balance system:

  • Deposits & Top-ups: You can add funds to your balance via Stripe Checkout. The minimum top-up amount is $5.00 USD.
  • Billing: Analysis fees are deducted directly from your account balance at the moment of submitting an analysis request. Pricing tiers are:
    • Step-by-step editing guide: $0.50 USD
    • Lightroom preset: $1.00 USD
    • Bundle (Both options): $1.20 USD
  • Refunds: Prepaid balances are non-refundable and hold no monetary value outside of the services offered by Apertist.

5. User Conduct & Content Rights

You retain all rights to the images you upload. However, you grant Apertist a temporary, non-exclusive license to process and transmit the image metadata/data and solely to perform the requested analysis.

You agree not to upload any content that:

  • Infringes upon any third-party intellectual property or privacy rights.
  • Is unlawful, harmful, threatening, abusive, defamatory, or obscene.
  • Contains software viruses or any code designed to disrupt our platform.

6. Limitation of Liability

In no event shall Apertist, its operators, or partners be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the services, even if notified of the possibility of such damage.
